LEGAL PROCEDURE:

  • The title- deed registration office in Turkey fulfils the transfer of property. If the reason of transfer is a sale, the purchaser and the vendor (or their representatives) apply to the title-deed registration office with all necessary documents. The property is then registered on behalf of the purchaser in the presence of both the purchaser and the vendor or their attorneys.
  • Before registration takes place, research will be performed by a government body to ensure that the property is not in a prohibited region and is suitable to be acquired by a non-citizen person or company. A permission document will then be issued and sent to the title-deed registration office. The document is received within 4-6 months from date of application.
  • When a foreign national agrees to a purchase a property in Turkey , information regarding Turkish Law and legal procedures is provided by your solicitor, who checks the title-deed record of the property to find out if there is any lean, debt or mortgage. They will then arrange relevant sale agreements. ETD has a client bank account where our clients can transfer payments. Your solicitor will also apply for the Government Clearance and when clearance is received, the property is registered in the names of the client/s. Your solicitor completes the entire process on your behalf, by power of attorney, arranged by a public notary.
  • During the entire procedure, we keep in touch with all our clients; to ensure they are fully informed at every stage of the process. If there is a construction agreement, your solicitor can check the construction regularly and send a report to the client. Your solicitor will arrange a civil engineer to carry out this work.
